Prof. Kariuki Muigua

Overview

Hon. Prof. David Kariuki Muigua is a distinguished law scholar, Environmental Consultant, accomplished mediator, Chartered arbitrator, a holder of a PhD in law from the University of Nairobi and with widespread training and experience in international and national commercial arbitration and mediation.

Hon. Prof. Muigua is a Fellow of Chartered Institute of Arbitrators (CIArb)-Kenya chapter. He is also a Chartered Arbitrator. He has served as the Branch Chairman of CIArb)-Kenya from 2012 to 2015. He has widespread training and experience in policy formulation and the legislative process. He is highly knowledgeable about the Kenyan legal system and has previously been consulted on drafting Bills and regulations.

He is an Advocate of the High Court of Kenya of over 26 years standing and practicing at Kariuki Muigua & Co. Advocates, a firm that specialises in environmental law and natural resources research and practice, ADR, constitutional law and commercial law litigation. The firm is also listed as a leading Kenyan commercial law firm in the distinguished Martindale Hubbell Directory.

He has undertaken specialised courses specifically on Environmental Impact Assessment (EIA) and Environmental Audit (EA) which earned him the EIA/EA lead expert accreditation by the National Environmental Management Authority of Kenya (NEMA). He is a Lead Consultant and Expert at Pristine Consultants, an Environmental Law and Policy Consultancy firm drawing its clientele from Kenya and elsewhere around the world.

His research interests include Environmental and Natural Resources Law, Governance, Human Rights and Constitutionalism, Conflict Resolution, International Commercial Arbitration, The nexus between environmental law and human rights, Land and natural resource rights, economic law and policy of governments with regard to environmental law and economics.

Hon. Prof. Muigua has also collaborated with various environmental advocacy groups in Kenya and regionally. He works with professionals affiliated to the National Environmental Management Authority (NEMA) especially in the areas of Environmental Resources and their management through Environmental Impact Assessment (EIA), Mediation and Public Participation. He advocates the setting up of effective policy, legislative and institutional frameworks for the resolution of environmental conflicts. He is an ardent commentator and contributor to debates on constitutional review, and governance and has worked closely with stakeholders in the areas of constitutionalism and access to Justice.

He is also a lead auditor/implementer of BSI ISO/IEC 27001:2005 (Information Security Management Systems) and consults on the same.

Hon. Prof. Muigua teaches law at the Centre for Advanced Studies in Environmental Law and Policy (CASELAP) and the School of Law, University of Nairobi. He is widely published in the areas of environment and natural resources, ADR and access to justice.

Previously, Hon. Prof. Muigua has been engaged as a consultant by various bodies on diverse issues falling within his areas of practice and research interests.

Accolades

Prof. Kariuki Muigua has been consistently recognized for his excellence in dispute resolution, particularly arbitration. Ranked in Band 1 of Dispute Resolution (Arbitrators) by Chambers and Partners Global Guide 2024 and 2023, he is noted as one of the Top 6 Arbitrators in Kenya, with commendations for being “highly recommended as a leading lawyer.”

In 2024, he was honoured as the ‘Academic Champion of ADR’ at the inaugural Women in ADR Awards. He received the Outstanding Mentor Award, a recognition by his mentees for his guidance, care, and support.

Prof. Muigua’s contributions as the Chartered Institute of Arbitrators (CIArb) Africa Trustee (2019-2022) earned him recognition at the CIArb Kenya Branch ADR Excellence Awards 2022, where he was awarded for his exemplary service.

His highly regarded book, Settling Disputes through Arbitration in Kenya, 4th Edition (Glenwood Publishers, 2022), received the Publication of the Year Award 2022 at the CIArb Kenya Branch ADR Excellence Awards.

He was recognized as the ADR Practitioner of the Year at the AfAA Awards 2022 and named African Arbitrator of the Year at the 3rd African Arbitration Awards 2022, held in Kigali, Rwanda.

In 2021, Prof. Muigua was the recipient of the inaugural CIArb Kenya Branch ADR Lifetime Achievement Award and the ADR Publication of the Year Award. The Law Society of Kenya, Nairobi Branch also honored him with the ADR Practitioner of the Year Award 2021 at the Nairobi Legal Awards.

Further cementing his scholarly impact, he received the prestigious C.B. Madan Prize (2020) for his outstanding contributions to constitutionalism and the rule of law in Kenya.
